After the kerfuffle recently about one of the NSFW instances allowing drawn CSAM, I reckon you could get in trouble if you federate with an instance like that if you're hosting in a jurisdiction where that sort of content is illegal. Or imagine in the future, deepfake celebrity porn may get federated onto your instance and put you in the firing line for hosting that illegal content. NSFW is the most obvious, but I think there could be ramifications for hosting content on your own instance federate din from elsewhere that is illegal in your jurisdiction.

Is nsfw content shown by default? Surely it'd be a more welcoming experience for it to be off by default, and then the user has to actively want it to be shown it.

That's where I landed too. I'm tempted to run my own instance just for me to avoid hassle with defederations down the line, but it's a no-brainer to block all nsfw content right now, the risk is crazy.

I have a question about the potential legal problems. If I host my own instance and federate with a server that (like lemmynsfw.com for the sake of argument) allows NSFW content of drawn minors (or apparent minors, whatever, the details don't matter), their content is copied onto my instance and I'm not hosting that content, right? So if that content is illegal in my home country, am I now hosting illegal content?

Honestly, we should just leave it behind and focus on making communities here better. They have every right to cut off their nose to spite their face on their own website. Let's learn from that for the future in contributing to making someone else's website great.
